Behind on your mortgage in Texas? You have options.

Missing payments is stressful, and it is more common than you think. Here is how the process works in Texas, what you can do at each stage, and how a direct as-is sale compares. Plain language, no pressure.

Free, private, no obligation. Offers come to you in writing.

What usually happens when you fall behind

Timelines vary by lender and loan type, but the steps generally look like this.

You miss payments

Your lender usually starts with late fees, calls and letters. This is the best time to contact them, because more options are open early.

Notice of default

If you stay behind, the lender sends a written notice of default. In Texas, you generally have at least 20 days from that notice to catch up before the lender can move forward.

Notice of sale

If the loan is not brought current, a notice of sale is posted and sent, generally at least 21 days before the sale date.

Foreclosure sale

In Texas, foreclosure sales are held at the county courthouse on the first Tuesday of the month, between 10 AM and 4 PM.

These are general timelines. Your loan documents and loan type can change them, so read every notice you receive and ask your lender what applies to you.

How selling to us works

Simple, and you stay in control the whole way.

  1. Tell us about the house. Use the short form or call. The address and about how far behind you are is plenty to start.
  2. A real person follows up the same day. We ask a few questions about the loan, how much is owed and your timeline.
  3. You get a clear written offer if it makes sense. Whether the numbers work depends on what is owed compared to what the house is worth. We will tell you honestly either way. You can always say no.
  4. You choose the closing date. A title company handles the paperwork. If a sale is the right move, the mortgage is generally paid from the proceeds at closing.

We are a home buying company, not an attorney, lender or government agency. We will tell you honestly if selling to us is not your best move.

Your options

The right move depends on why you fell behind, how much you owe, and what you want to do with the house.

Talk to your lender

Ask about loss mitigation. Depending on your loan, a repayment plan, forbearance, loan modification or partial claim may be available. Get anything agreed in writing.

Reinstate the loan

If you can pay the past-due amount plus fees, the loan can be brought current. Ask your lender for a reinstatement quote with a good-through date.

Get free counseling

HUD-approved housing counselors help homeowners at no cost. They can walk you through your options and help you talk with your lender.

Sell the house

Selling before the auction can stop the foreclosure and protect your credit more than a foreclosure would. You can sell with an agent, or directly to a cash buyer like us, as-is, with no repairs and no commissions.

General information only, not legal or financial advice. For your specific case, talk with a licensed Texas attorney, a HUD-approved housing counselor or your lender.

What helps us give you a straight answer

You do not need all of this to get started. Share what you have:

  • The address and a short description of the condition.
  • How far behind you are, and whether you got a notice of default or a notice of sale. A sale date helps a lot.
  • About how much is left on the mortgage, and who the lender is.
  • Whether anyone lives in it or it is vacant or rented.
  • Your goal: keep the house if you can, or move on if you cannot.

Questions people ask

How many payments can I miss before foreclosure in Texas?

There is no single number. Lenders generally wait a few months, then send a notice of default with at least 20 days to catch up. Your loan type and documents can change the timeline, so ask your lender.

Can I sell my house if I am behind on payments?

Often yes. If the house is worth more than what is owed, the sale can pay off the mortgage at closing. If more is owed than the house is worth, other approaches may be needed, and we will tell you honestly what is possible.

Will selling stop the foreclosure?

If the sale closes before the foreclosure sale date, the loan is paid off and the foreclosure does not go forward. Timing is tight, so reach out as early as you can.

Do I have to fix the house first?

No. We buy as-is, so there are no repairs and no cleaning out.

Is there a fee, or do I pay commissions?

No fee to ask, and no agent commissions when you sell directly to us. Every offer comes to you in writing and you can say no at any time.

Do you promise to buy my house?

No. We look at each situation and give a written offer if the numbers work. If selling to us is not your best move, we will say so.
